MN is an 18 year old young woman who has been diagnosed with OCD, ADHD, and Intermittent Explosive Disorder. Her intermittent explosive disorder can lead her to have outbursts of anger. Her outbursts of anger can lead her to act impulsively by yelling, throwing objects, and hitting people – especially people close to her. On August 9, 2026, MN had one of her outbursts and shoved her mother to the floor and then banged her mother’s head against the wall. On September 3, 2026 MN had another outburst and hit her mother’s boyfriend in the head twice; he in turn pushed her away. The police were called. No one got arrested. The police, however, filed the following applications for criminal complaints:
- Assault & Battery against MN for the August 9, 2026 striking of her mother.
- Assault & Battery against MN for the September 3, 2026 striking of the mother’s boyfriend.
- Assault & Battery against the mother’s boyfriend for pushing MN.
The Applications for criminal complaints were set down for a Clerk-Magistrate Hearing in Woburn District Court on October 21, 2026. MN’s family consulted with and retained Attorney Robert Lewin from Andover to represent MN. Attorney Lewin immediately got MN’s family to furnish Attorney Lewin with a current mental health report for MN. At the same time Attorney Lewin spoke with the police prosecutor. (Attorney Lewin, himself, was the former Chief Prosecutor from the DA’s Office in Woburn Court. He is well liked and respected at that court.) Attorney Lewin explained MN’s mental health issues to the prosecutor and the fact that MN had no criminal record. MN’s family told Attorney Lewin that they did not want MN to get a criminal record. MN had no interest in seeing the mother’s boyfriend prosecuted.
On October 21, 2026 MN and Attorney Lewin appeared at Woburn District Court for the Clerk-Magistrate Hearing. In addition, the mother’s boyfriend and his lawyer were present. Attorney Lewin had been able to work out an agreement with the Police Prosecutor to have NO complaints be issued against anyone. Attorney Lewin explained to the lawyer for the Mother’s boyfriend that Attorney Lewin had worked out everything. The case was called and Attorney Lewin and MN and the mother’s boyfriend and his lawyer all entered the hearing room. The police prosecutor was there and the Clerk-Magistrate was there. Attorney Lewin explained that all sides were in agreement that no criminal complaints be issued against anyone. The police prosecutor indicated his agreement. The Clerk-Magistrate, however, is not bound by any agreement that the parties may have reached; nevertheless, in light of the fact that all parties were represented by counsel and in light of trhe fact that all parties were in agreement, the Clerk-Magistrate went along with the agreement and ordered that NO complaints were to be issued against either MN or the mother’s boyfriend.
Everyone then left the hearing room and the mother’s boyfriend’s lawyer turned to Attorney Lewin and said to him “Boy, you know everyone!” How true those words are.
Attorney Lewin then explained the following to MN :
- The Clerk-Magistrate had DENIED the two applications for Criminal Complaints that had been filed against MN.
- NO criminal complaint was issued against MN.
- MN had NOT been charged with any criminal offense.
- MN did NOT have to return to court and go before a Judge.
- NO entry would be made in the CORI (Criminal Offender Record Information) System against MN.
- MN had NO criminal record as a result of this.
Results like this are common for Attorney Robert Lewin. Attorney Lewin was an Assistant District Attorney from 1972-1975. For the last 51 years Attorney Lewin has limited his practice to criminal defense. His success with winning cases at every level including Clerk-Magistrate Hearings is extensive. There are very few lawyers in Massachusetts who bring the years of experience, breath of knowledge, and simple “know-how” that Attorney Robert Lewin brings to every case and every client.
